1. Use of the App

The App provides digital tools and services for:

• Institutional management
• Educational communication
• Payroll processing
• Personalized in-app store for physical goods

You agree to use the App lawfully and in compliance with all applicable laws of Bangladesh and international regulations.

2. Accounts and Access

Certain features require registration with accurate details, including name, email, phone number, and institution information. You must keep login credentials secure and notify us of unauthorized use. Institutional users may need to submit official verification documents. Invalid or missing documents may lead to restricted access or account deactivation.

3. Restrictions

• Do not use the App in violation of laws.
• Do not post false, offensive, or infringing content.
• Do not attempt to hack, disrupt, or interfere with the App.

Notify Arc is not responsible for illegal use of data by other users.

4. Content and User Uploads

Institutional Content: Uploaded by authorized admins for schools and institutions. We strive for accuracy but do not guarantee it.

User Content: When you upload documents, images, or files, you grant us a limited license to store and process them for educational, payroll, or store purposes. You retain ownership of your uploads and must ensure they don’t violate laws or third-party rights.

5. Store Feature, Personalization & Payments

Store Personalization

Recommendations may be customized using role, class, institution, and activity data to improve relevance.

Transactions & Payments

• Basic contact and class data may be used to process payments or payroll.
• We do not store full card or bank credentials; payments are processed by authorized providers.

Third-Party Payment Processors

• We act as a facilitator for payments routed to providers.
• We are not responsible for bank errors, declines, or disputes.
• Disputes must be handled with your payment provider or bank.

Physical Goods

• Products are sold by independent sellers or institutions.
• Payments cover offline educational goods or services.
• Refunds and returns follow seller and provider policies.

6. Third-Party Sellers, Manufacturers & Delivery

• Notify Arc does not manufacture or deliver products.
• Sellers are responsible for product quality and delivery.
• We may share order details with logistics or payment partners to fulfill purchases.
• We never sell or resell store data to unrelated third parties.

7. Privacy & Data Protection

Governed by our Privacy Policy.

Collected data includes emails, phone numbers, class info, uploaded files, and payment metadata. You may request deletion in line with the Privacy Policy. Future personalized ads will include opt-out controls.

8. Security and Limitation of Liability (Data Breach)

We apply encryption and technical controls but cannot guarantee absolute security. We are not liable for breaches or hacking beyond our control. We comply with data breach notification laws and encourage users to protect their credentials.

9. Disclaimer and Limitation of Liability

The App is provided “as is.” Notify Arc, its affiliates, and partners are not liable for indirect or consequential losses, including salary issues, purchase disputes, or payment errors. Any payment dispute must be directed to the payment provider or bank.

10. User Conduct, Misuse, and Reporting

Users are responsible for their content and actions. Report illegal use or misuse to support@notifyarc.com. We may suspend accounts, remove content, and cooperate with authorities as needed.

11. Indemnification

You agree to indemnify and defend Notify Arc against claims, losses, or expenses from your misuse, violation of Terms, uploaded content, or off-platform payment disputes.

12. Termination

We may suspend or terminate access for violations or unlawful activity. Termination does not affect our right to pursue legal remedies.

13. Changes to Terms

We may update these Terms and publish them with a new effective date. Continued use after updates constitutes acceptance.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Bangladesh. Disputes fall under the exclusive jurisdiction of Dhaka courts, subject to international law.

15. Intellectual Property

All rights to the App, including design, code, and content, belong to Black Banner or its licensors. Copying, modification, or redistribution requires prior written consent.
